Want a Public Skatepark?
It seems that the majority of the problem with building public skateparks is getting insurance. Strangely that's
because lawmakers don't consider skateboarding a "Hazardous Sport". The State of California, like many states, has a list
of what is considered "Hazardous", and what is not. Things like bicycle jumping, mountain biking, swinging from ropes in
trees, waterskiing, animal riding, or any activity that includes physical contact (like baseball, football, basketball or soccer)
are all considered "Hazardous". What "Hazardous" status does is prevent people from suing the Public Entity (City, County,
State) involved if they get hurt performing that activity in a public place (you can't sue because you were performing a known
"Hazardous Activity"). If the activity is not listed as "Hazardous" then you are free to sue any Public Entity involved if you
get hurt in a public place. Skateboarding is considered not "Hazardous" therefore it is extremely hard to get insurance for
skateboard parks due to the lawsuit risks if someone gets hurt. If you get hurt playing basketball on a public basketball court
you cannot sue the city but if you get hurt skateboarding on that same basketball court you can. That is the primary reason
most cities outlaw skateboarding and will not support a skatepark while they will support a baseball diamond or a basket-
ball court or a soccer field. It's all just about legal liability and government bureaucracy.
The International Association of Skateboard Companies (IASC) wants to get skateboarding added to the State of
California's "Hazardous Activity" list and thereby pave the way for cities and counties to legalize skateboarding and build
insurable safe skateboard parks just as easily as they build basketball courts... with no fear of lawsuits. IASC members have
been sending letters to lawmakers with regard to this subject. One problem with getting skateboarding added to this list is
that the California Association of Joint Consumer Attorneys has a powerful lobbying group in the State Capitol that does not
want to lose the right to sue the cities and counties for skateboard related accidents... They have recently kept skateboard-
ing from being added to the "Hazardous Activities" list. Currently lawyers can make a lot of money by suing cities. If you
get hurt skateboarding on city property you can sue the city and any payment you and your lawyer receive comes from the
taxes we all pay. If you get hurt playing basketball you can't sue... and therefore you see basketball courts in almost every
city park around. Skateboarding is just as dangerous as basketball and skateboarders deserve to have city sponsored
skateparks just as much as basketball players deserve to get city sponsored basketball courts.
If you are a California resident what you can do is sign below and give your name and address and zip code so
that IASC can take your signature along with the signatures of all of it's members to the various Senators involved and show
them that they have the support of skaters and skateboard companies in adding skateboarding to the "Hazardous Sport"
list. If skateboarding gets on this list we will open the door to skateparks and the widespread legalization of skateboarding.
At this point IASC is working on this in California only... but if they can get it to pass here it will be much easier to
get through the other state legislatures. IASC needs your enthusiastic support. Please copy this page and give it to your
friends and have them sign and send to IASC at: IASC HRA list, P.O. Box 37, Santa Barbara, CA 93116. IASC will for
ward your mail to the correct California Senators. Please also give a copy of this page to any Newspapers, TV stations,
Police, Teachers, Parents, Mayors, City Council Members Etc. to help them understand the reasoning behind skateboarding's
status and the steps required to keep skateboarding legal and make public skateparks a reality.

cities will be able to build safe skateboard parks.
